The practice of paternalism has changed along with developments in medicine, philosophy, law, sociology and psychology. Physicians have learned that a patient's values are a factor in determining what is best for that patient. Modern paternalism continues to be guided by the principle that the physician decides what is best for the patient and pursues that course of action, taking into account the values and interests of the patient. In the autonomy model of the doctor-patient relationship, patient values are decisive. (...) In the paternalistic model, they are but one among several factors the physician must consider in making a medical decision. To describe the content of practice guidelines on euthanasia and assisted suicide (EAS) and to compare differences between settings and guidelines developed before or after enactment of the euthanasia law in 2002 by means of a content analysis. Most guidelines stated that the attending physician is responsible for the decision to grant or refuse an EAS request. Due care criteria were described in the majority of guidelines, but aspects relevant for assessing these criteria were not always described. Half of the (...) guidelines described the role of the nurse in the performance of euthanasia. Compared with hospital guidelines, nursing home guidelines were more often stricter than the law in excluding patients with dementia (30% vs 4%) and incompetent patients (25% vs 4%). As from 2002, the guidelines were less strict in categorically excluding patients groups (32% vs 64%) and in particular incompetent patients (10% vs 29%). Healthcare institutions should accurately state the boundaries of the law, also when they prefer to set stricter boundaries for their own institution. Only then can guidelines provide adequate support for physicians and nurses in the difficult EAS decision-making process. (shrink)

In Varieties of Religious Experience: A Study in Human Nature William James examines the role of mysticism in the development of religion. James argues that the root of all religions is precisely the experience of mystical states of consciousness. As we shall see, although James himself admits that his own psychological constitution shuts him out from these experiences, the acknowledgement of practical developments of mysticism within institutionalized religions illustrates the reality of these states of consciousness, a stance supported by James’ (...) pragmatism. John Rawls’ use of a contractarian strategy for justifying basic principles of justice has raised the hope that a similar strategy might work for a theory of right and moral principles generally. I want to show that this hope cannot be fulfilled.In what follows I interpret contractarianism in a Rawlsian way on the grounds that his is the most plausible version of the doctrine we are likely to get. I am not however concerned with the details of Rawls’ argument for (...) justice but instead with an idea that appears to underlie the contractarian strategy. In order to avoid the complications of Rawlsian exegesis, I choose to discuss the doctrine as it might be used to justify a moral principle of mutual assistance and not as Rawls in fact uses it to justify principles of justice. Controversy surrounds several experiments that have addressed whether selective synaptic strengthening occurs during learning. To date, the evidence suggests that widespread alterations in synaptic strength, through either kindling or electroconvulsive shock, can disrupt this hypothetical process. The lack of evidence for selective modification of learning through LTP stimulation, however, provides difficulties for both the prevailing hypothesis and the hypothesis advanced by Shors & Matzel. Subsequent experiments may indicate a role for LTP in both learning and arousal.

In an earlier study I argued that the appearance of the name of Memmius in the first, second, and fifth books alone of Lucretius de Rerum Natura is only the most striking indication of a fundamental change in the poet's attitude towards his reader which is already well established quite a short way through book 5, and which makes it almost incontestable that Lucretius wrote books 3, 4, and 6 after he had lost all hope of converting Memmius to Epicureanism.
